1. Acceptance of Terms

By accessing or using Total Recall ("the Software"), including the website at mytotalrecall.app ("the Website") and the desktop application, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Software.

2. Description of Service

Total Recall is a desktop application that provides AI-powered video search and indexing. The Software processes video files locally on your device using machine learning models to enable natural language search across your video footage. The Website provides account management, license purchasing, and application downloads.

3. Account Registration

To use certain features, you must create an account. You agree to:

  • Provide accurate and complete registration information.
  • Maintain the security of your account credentials.
  • Notify us immediately of any unauthorized access to your account.
  • Accept responsibility for all activity that occurs under your account.

4. License and Usage

4.1 License Grant

Upon purchasing a lifetime license, we grant you a non-exclusive, non-transferable, perpetual license to use the Total Recall desktop application on your personal devices for personal or internal business use.

4.2 Restrictions

You may not:

  • Redistribute, sublicense, or resell the Software.
  • Reverse engineer, decompile, or disassemble the Software, except where permitted by law.
  • Use the Software for any unlawful purpose.
  • Share your license key or account with others.
  • Remove or alter any proprietary notices or labels on the Software.

4.3 Updates

Your lifetime license includes all future updates and new features at no additional cost. We may release updates at our discretion and are not obligated to maintain backward compatibility with older operating system versions.

5. Payment and Refunds

5.1 Pricing

Total Recall is offered as a one-time lifetime purchase. Prices are displayed in USD and are subject to change. Any price changes will not affect existing license holders.

5.2 Payment Processing

All payments are processed securely through Stripe. By making a purchase, you also agree to Stripe's Terms of Service.

5.3 Refunds

We offer a 14-day refund policy from the date of purchase. If you are unsatisfied with the Software, contact us within 14 days for a full refund. After 14 days, purchases are non-refundable.

6. User Content and Data

6.1 Your Video Data

You retain full ownership of all video files, images, and data processed by Total Recall. The Software processes your content locally on your device, and we have no access to, claim over, or responsibility for your content.

6.2 Responsibility

You are solely responsible for ensuring that your use of the Software complies with all applicable laws, including but not limited to privacy laws, surveillance laws, and data protection regulations in your jurisdiction. You must have proper authorization to process any video content you use with Total Recall.

7. System Requirements

Total Recall requires macOS 14 or later with an Apple Silicon processor. We do not guarantee compatibility with all system configurations. System requirements may change with future updates.

8. Disclaimer of Warranties

THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SOFTWARE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

AI-powered search results are generated by machine learning models and may not always be accurate. Total Recall should not be used as the sole basis for critical decisions.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL TOTAL RECALL, ITS DEVELOPERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OR INABILITY TO USE THE SOFTWARE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SOFTWARE.

10. Intellectual Property

Total Recall, its logo, and all related materials are the intellectual property of Total Recall and its developers. These Terms do not grant you any right to use our trademarks, logos, or branding without prior written consent.

11. Termination

We reserve the right to suspend or terminate your account if you violate these Terms. Upon termination, your license to use the Software will be revoked. You may terminate your account at any time by contacting us. Termination does not entitle you to a refund unless within the 14-day refund period.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of any material changes by updating the "Last updated" date at the top of this page. Your continued use of the Software after changes constitutes acceptance of the updated Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved through good-faith negotiation, and if necessary, through binding arbitration.
